Agreement/Release

ELIGIBILITY REQUIREMENTS *

1. You must be at least 18 years of age as of Dec.1, 2025 to apply. 2. You must not be a candidate for public office and must agree not to become one until after one (1) year after the initial exhibition of the episodes of the Program in which you appear, if selected as a participant. 3. You must be legally authorized to live and work in the United States on the Program (as defined in the Release), or you are in the process of attempting to obtain lawful authorization so that you will be able to legally live and work in the United States on the Program by the time pre-production begins on or around December 1, 2025 4. You will need to be available during the production dates (which dates shall be determined by Producer in its sole discretion). 5. If you are selected as a potential participant you must execute waivers and release agreements required by Producer or any of their licensees, successors or assigns. 6. Any offer to become a participant may be conditioned upon your submission to a background check, in accordance with applicable laws.

By completing this form, you are allowing our casting team to put you into consideration for participating in the Series (as defined below) and represent and warrant that you are eligible under and agree to be bound by, the following eligibility requirements. *

APPEARANCE RELEASE 1. For good and valuable consideration, receipt of which is hereby acknowledged, I authorize Content Group Productions, LLC (“Producer”) and any programming service or other platform of Discovery Communications, LLC (“Network” or “DCL”) and their respective parents, affiliates, subsidiaries, licensees, successors and assigns to film, videotape, and otherwise record me and my voice, including any musical composition(s) (collectively, the “Recordings”), and to use my name, likeness, signature, image, persona, and biographical information (collectively, my “Appearance”) in and in connection with the program tentatively entitled: “HGTV HOMES FOR SALE” (“Program”). I acknowledge and agree that Producer shall be the exclusive owner of the Recordings, with the perpetual right, throughout the universe, an unlimited number of times, in any manner and in all media (now known or hereafter invented), to copyright, use, and license others to use the Recordings in connection with the Program or otherwise, including in the promotion, advertising, sale, publicizing, merchandising, and exploitation of the Program or Network. Producer shall have the right, but not the obligation, to produce the Program and to use my Appearance and the Recordings in the Program, and to edit, modify, remove, and incorporate additional elements into the Program as Producer, in its sole discretion, sees fit. 2. Any statements I make during my participation in the Program are true, to the best of my knowledge, and neither they nor my participation will violate or infringe upon the rights of any third party. I hereby waive any right of inspection or approval of my Appearance or the uses of my Appearance. I understand that in and in connection with the Recordings, I may reveal or relate, and other parties may reveal or relate, information about me of a personal, distressing, unflattering, or private nature, and Producer and others have my full consent to include any such information in the Program. 3. I acknowledge and agree that this is a non-union agreement, and that my participation in the Program is not employment and shall not be subject to the terms of any collective bargaining agreement or entitle me to any compensation or benefits of any kind. 4. I hereby release Producer and Network and their respective parents, affiliates, subsidiaries, licensees, employees, successors and assigns (collectively, the “Releasees”) from any and all liability, claims or expenses of any kind (collectively, “Claims”) arising from or in connection with my Appearance, the Recordings, my participation in the Program, and/or the exploitation thereof, including without limitation any Claims based upon any alleged personal injury, death, property damage, defamation, invasion of privacy and/or infringement of any other proprietary and/or personal rights. I will defend, indemnify and hold harmless the Releasees from any Claims and any breach or alleged breach by me relating to this Release. I acknowledge that Producer will rely on this Release and all permissions granted herein, at substantial cost to Producer, and therefore this Release is irrevocable. I am not relying on any promises or statements made by anyone in connection with the Program, including, without limitation, about the nature or content of the Program, the nature of any investigation to be carried out in the Program, or that investigation’s theories, findings, and/or conclusions. My sole remedy in the event of any claim against Producer and/or Network shall be the recovery of money damages and in no event shall I seek or be entitled to rescission, injunctive or other equitable relief. 5. The laws of the State of California shall govern the entire relationship between the parties, including, but not limited to, any breach of contract, quasi-contractual, or extra-contractual tort claims relating to the Release or my participation in the Program. If a dispute arises out of or relates to this Release or my participation in the Program and is not resolved through direct discussions or mediation, the parties agree that the controversy or claim shall be resolved by final and binding confidential arbitration administered by JAMS in accordance with its streamlined arbitration rules and procedures or subsequent versions thereof. To the extent this arbitration provision is not enforced or court proceedings are otherwise commenced, the parties consent to the exclusive jurisdiction of the state and federal courts in the County of Los Angeles in the State of California. 6. From the date of this Release through 6 months after the initial exhibition of the final episode of the Program in which I appear, I agree not to participate in any programming or content (in all forms of media) that concerns the subject matter of the Program without Network’s prior written approval (the “Exclusivity Period”). In addition, during the Exclusivity Period, unless I have obtained Producer and/or DCL’s prior written consent in each instance, which consent Producer and/or DCL may grant or withhold in its sole discretion, I will not endorse (using my name and/or likeness or otherwise) nor render services for or on behalf of (i) any product or service competitive with a product or service of a sponsor or advertiser of the Program, DCL, or with any “DCL Service” (i.e., any content service in which DCL has an ownership interest or controls or shares control of content decisions, or to which DCL supplies content to be packaged with a DCL trademark or logo) and/or DCL product, including but not limited to, merchandising, home video and media company services; or (ii) a sponsor or advertiser of the Program or the Network or any product or service of such sponsor or advertiser. I hereby agree that I will not, following the date hereof and prior to expiration of the Exclusivity Period, (i) enter into any merchandising or publishing agreement, any endorsement agreement or any commercial or manufacturing tie-in agreement, or any other agreement or commitment whereby my Name and Likeness may be used during the Exclusivity Period, except as required by Producer and/or DCL hereunder; or (ii) develop a competing product line to any of DCL’s consumer products for the Program. During the Exclusivity Period, Producer and/or DCL shall have approval over any and all third-party requests for my services (including, without limitation, publicity and personal appearance requests). 7. This is the entire agreement and it supersedes all prior oral or written understandings and communications. This Release and the acknowledgements, representations, releases, permissions and agreements made herein shall be irrevocable and binding upon me and my heirs, executors, successors, parents, guardians, licensees and representatives. The illegality, invalidity or unenforceability of any specific provision shall in no way affect the remainder of this Release. This Release cannot be terminated, rescinded or amended, except by a written agreement signed by both Producer and me. It may be executed by original, facsimile or electronic signature in a form acceptable to Producer. I shall execute any documents, and do any other acts that are necessary to evidence, effectuate or protect any of the rights granted by me or support any of the representations or warranties made by me. Nothing in this Release shall limit or restrict any rights otherwise enjoyed by Producer and/or Network under law or contract.
